General Terms

The General Conditions presented below establish the terms and conditions governing the provision of services by Paulo Jorge Batista Garcia (ENI), headquartered at Rua José Maria Raposo de Amaral, nº 35, 9500-078 Ponta Delgada, with the VAT number 187763887.

The customer's knowledge and acceptance are manifested through a checkbox validation for this purpose in the booking form, and the customer's Privacy Policy is also known.

  1. Over these General Conditions, any Particular Conditions of a particular service and/or promotional campaign prevail, and also, over both Conditions, others expressly stipulated in writing between Paulo Jorge Batista Garcia and the customer. By purchasing a service, the customer accepts all the terms and conditions established.
  2. Payment terms may vary according to the service provided. In the absence of specific conditions, the general conditions apply, under which the client must pay 50% of the total price of accommodation at the time of booking and the remainder 14 days before check-in.
    1. If the booking is made less than 14 days before the check-in date, the total price will be paid at time of booking.
    2. A reservation can be canceled by Paulo Jorge Batista Garcia if there are payments not made by the customer under the conditions described above.
  3. Cancellation of a confirmed reservation between 30 and 14 days before the start of the service implies a retention of 50% of the reservation amount to cover administration fees. The remainder will be refunded to the customer.
    1. If cancellation is communicated less than 14 days before the start of the service, there will be no refund. Furthermore, once the stay has started, the customer is not entitled to any refund for unused services.
    2. If cancellation is communicated more than 30 days before the start of the service, the amount already paid will be refunded in full, less any transaction costs that may have to be borne by Paulo Jorge Batista Garcia.
  4. Any change in the booking made requires the express agreement of Paulo Jorge Batista Garcia, which may imply changes in the price and/or be subject to the payment of fees, calculated according to the type of booking, the date of change and the applicable rate.
  5. Value Added Tax is included in the price of the service.
  6. Whenever there are reasons that justify it, the accommodation unit may be replaced by another one of the same or higher category, by written agreement with the client and without any increase in the price paid by the client.
  7. If unforeseen circumstances force Paulo Jorge Batista Garcia to cancel a reservation without the Customer having failed to comply with their duties, or if the Customer does not accept an amendment to their reservation within the scope of the provisions of number 5 of these Conditions, the Customer you will be entitled to a full refund of amounts paid.
  8. The stay of a child up to 2 years old is not charged, as long as they stay in the same accommodation unit as the adults responsible for them. However, the client must always inform about the inclusion of children in their reservation. Reservation acceptance may be subject to the number of cribs and/or extra beds available, as well as the space available in the accommodation unit.
    1. It is the customer's responsibility to inform the number of people (adults and children) who will occupy the accommodation unit. In the event of more people than those reserved, entry may be refused without refund.
  9. Check-in time is 4:00 pm. Check-out time is 11:00. Exceptions may be allowed, as long as they have no effect on other reservations and/or on the cleaning work of the accommodation unit.
  10. Meals – Paulo Jorge Batista Garcia does not offer meals or breakfast.
  11. Pets are not accepted except guide dogs.
  12. The client is obliged to indemnify Paulo Jorge Batista Garcia for any damage caused to the accommodation unit and/or its support facilities, as well as any damage arising from the breach of the duties provided for in these general conditions, including, in particular, fees for lawyers and court costs.
  13. Before check-in, the customer can pay for the services via bank transfer, PayPal, credit card, MBWay, or ATM reference. Cash payments are not accepted.
  14. Paulo Jorge Batista Garcia reserves the right to change these General Conditions at any time.
  15. In the event of a consumer dispute, the consumer may resort to the European Online Dispute Resolution Platform, available at http://ec.europa.eu/consumers/odr or to alternative consumer dispute resolution entities.

  16. For the resolution, through the courts, of all disputes arising from this contract, namely those relating to its interpretation, execution, non-compliance, invalidity, resolution or reduction, in which it has not been possible to reach an amicable solution, it is stipulated the jurisdiction of the District of Ponta Delgada, expressly waiving any other.
